Sabah PH representatives file suit over 40pc revenue share formula for state

KOTA KINABALU: Twelve elected representatives from Sabah Pakatan Harapan (PH) filed an originating summons (OS) on Friday at the Kota Kinabalu High Court on the issue of the 40pc Special Grant due to Sabah as stipulated in the Federal Constitution.

They named the Federal and State Governments as defendants.

Basically, the lawmakers are seeking a court declaration that Article 112C and Section 2(1) of Part IV of the Tenth Schedule of the Federal Constitution still apply and are enforceable.

They are also seeking declarations that a review of Putrajaya’s annual grant to Sabah should have been carried out in 1974 and that the 2022 review pursuant to Article 112D of the Federal Constitution (jointly announced by the Federal and State Governments in April this year) is unconstitutional.
